BT Phished, is it a copyright issue, or is BT consent implied?

Just received a BT Internet styled phishing email, inviting me to log in to a french website (watch out for topachatvente.fr) to authenticate.

I suppose the Phrench phishing phelon would claim he had BT's implied consent, and because the pages were published online he didn't require a copyright licence.

And there was no intent to commit a crime.
