I have made a Freedom of Information request to the police to ask them to clarify why there is insufficient evidence for a prosecution, but they are attempting to refuse on the basis that it is not in the public interest to do so. see below

This looks not like a refusal but an extension to the timescales. They have given themselves until 19th August to consider the public interest angle.

No, I think it started way before then:

Looks like the site is waiting for John Yorke to log in and update them on it.

At a guess, the police know that if they say they are doing nothing, they will get their *rse kicked, and if they say they are doing something, they will get their *rse kicked.

Accordingly, a senior officer has been drafted in to see which buttock is better protected....

I read it that they were requesting an extension until the 19th August to give them time to find an excuse to refuse to give the information.

The police are not to blame for what the ISPs have done or are contemplating doing.

I think it particularly unwise to be critical of the police at this time, especially as they have it in their power to do something about this issue.

That is is not to say that one shouldn't be frustrated with delays. Just remember it is the silly season when everyone is off on holiday, so seeking out relevant information and getting decisions made is much more difficult than usual.

The Police have a duty to protect the public.

If they do not, a complaint can be raised via the Independent Police Complaints Commission.

If they do nothing in this case, I think they will be chargeable under dereliction of duty.

The police need evidence. Even logs that are kept for 12 months are in danger of disappearing re the 2007 trial. Wait until the new trial and then there will hopefully be lots of evidence to pass their way.
