As you are well aware this is illegal under RIPA 2000 and the amendments made by the UK government in order to comply with the EU directive on privacy. These state that prior informed consent from both sender and recipient is necessary before any such interception can take place. My consent will NOT be forthcoming and you will cease and desist any attempt to intercept and scan any emails from or to the following email addresses, I am not a BT customer and am not bound by your dubious terms and conditions, which fall foul of the Unfair Terms and Conditions in Contract regulations and are therefore unenforceable in law. Furthermore the content of any email sent is the copyright of the sender and as such the scanning of the content of the said email is a breach of the sender’s copyright. I refer you to your own statements on your website and in your terms and conditions. Up to the 26th July 2011 2.6 The Services identify words, links, people and subjects from your email messages and other messages that are archived (including instant messages) to learn what matters to you so that Yahoo! can analyse, review and categorise this information for immediate and future use including, without limitation, to provide personally relevant product features and content, more relevant advertisements and for spam and malware detection. Amended on the 27th July 2011 2.6 The Services identify words, links, people and subjects from your email messages and other messages that are archived (including instant messages) to learn what matters to you so that Yahoo! can analyse, review and categorise this information for immediate and future use including, without limitation, to provide personally relevant product features and content, more relevant advertisements and for spam and malware detection. The information gathered during this process is not used for interest matched advertising. If you consent to this ATOS you are responsible for obtaining consent to this feature from other users you communicate with via the Services. Amended on 28th July 2011 2.6 The Services identify words, links, people and subjects from your email messages and other messages that are archived (including instant messages) to learn what matters to you so that Yahoo! can analyse, review and categorise this information for immediate and future use including, without limitation, to provide personally relevant product features and content and for spam and malware detection. The information gathered during this process is not used for interest matched advertising. If you consent to this ATOS you are responsible for obtaining consent to this feature from other users you communicate with via the Services. Amended 9th August 2011 – current version 2.6 The Services use automated scanning of your email messages (including archived messages) and other messages that are archived (including instant messages) to enable spam and malware detection and to enable delivery of enhanced product features (such as applications to handle attachments) that you may find useful. The information gathered during this analysis is not used for interest matched advertising. Yahoo! Global Communications Additional Terms of Service for Yahoo! Mail and Yahoo! Messenger http://info.yahoo.com/legal/uk/yahoo/mail/atos.html By using the Services, you consent to allow Yahoo!’s automated systems to scan and analyze all incoming and outgoing communications content sent and received from your account (such as Mail and Messenger content including instant messages and SMS messages) including those stored in your account to, without limitation, provide personally relevant product features and content, to match and serve targeted advertising and for spam and malware detection and abuse protection. Unless expressly stated otherwise, you will not be allowed to opt out of this feature. I don't know whether that is a good thing or a bad thing. AFAIK they haven't dropped it. All my mail via BT is set via the Classic mail interface to be forwarded immediately to a 3rd party domain mail system. I never updated to the new BTY mail interface so in theory I never consented to interception/scanning (nor did anyone who corresponds with me). All my folders on BT mail servers remain empty. Given the current fuss over google privacy (and the NOTW case, and the creation of an Interception Commissioner who can look at things done by private individuals and companies) I think things are slowly looking up. It's important that the new Interception Commissioner gets sent details of all and any cases that the police reject. His first statutory duty is to decide if there was a criminal INTENTIONAL interception (and if he says there was, then it goes back to the police!) - if not - then he has to decide if there was UNintentional interception (which is his line of interest) and then what monetary penalty to impose. I'm preparing a submission for him right now on some BlueCoat clients in the UK. Police wouldn't touch it so now the way is clear to approach him with it. | ||
