Over the past couple months, I've seen both sides of the debate, as we all have. But clearly the one thing that disgusts me the most in the blatant ignorant attitude by Phorm, BT, Virgin Media and Talk Talk towards Children.
When presented with the scenario, and subsequently questioned about it, they all say that the onus is 100% on the Paying Subscriber to the Broadband Service.
They completely disregard the EU DPA, which CLEARLY indicates that any child under the age of 13 years cannot a). give consent, b). be assumed to give consent in the absence of consent.
Additionally, they completely disregard the Random nature of life, from one individual to another. In regards that one child may ask permission from their Parents, who would then be in the position to 'Permit or Refuse Webwise'; and on the other hand another child will simply sit at a PC, without speaking to Parents and click Yes, at the Webwise 'Opt-Out' page; subsequently a clear violation of the Law occurs, which the interested ISPs and Phorm will put on the Parent's shoulders!
Then consider the view of Phorm and ISPs, that the Paying Subscriber should make the decisions, and be held responsible for such decisions made, and compare with the decisions made everyday by us all. The result, in the view of Phorm and the ISPs, is that children are no more than a by-product, with no mind, no freedom, no rights whatsoever.
They fail to recognise that children on the whole are likely to be the biggest contributers to the Internet, from Social Sites, Email, MSN, Online Gaming and so on. Think about it, go to your friends for a coffee - and where are the kids? Surprisingly they are online, whilst you are supping your coffee and dunking your digestives!
The argument that children should be monitored by parents relentlessly whilst online is a joke! Yet the argument that Bill Payer should foot the responsibilty is the strongest in the Phorm/ISP case, in regards of children.
I put it that children do not buy food - but they eat! They do not buy clothes - but they wear them! They do not pay tax - but go to School! Through all this and more, our children are not regarded as mere background noise by the Companies selling the products they use - in fact the opposite! These Companies go to great lengths to ensure that our children receive the same quality of Service that they will offer the Parents...
BT, Virgin Media, Talk Talk, if I pay the Bills - my kids ARE your Customers! You WILL extend the same level of Customer Service to my children as I expect for myself.
You WILL be held LEGALLY Responsible for any decision that my children make whilst using a product you supply them. And I WILL seek Legal Action against you if any of my children EVER are violated by your System.
